Potential gestational surrogates must be adult women who have healthy children of their own, voluntarily sign written consent and have no medical contraindications. Gestational surrogates should not have a direct genetic link to the newborn. Close relatives of the Intended Parents are also allowed to carry the child for them. However, gestational surrogates must not be egg donors at the same time, which means they may not have a direct genetic link to newborns.
Medical contraindications to gestational surrogacy are as follows: somatic and mental diseases for which pregnancy and childbirth are contraindicated; length of uterus is less than 35 mm; any acute inflammatory diseases at the time of assisted reproductive technology (ART) application; congenital or acquired uterus deformities preventing embryo implantation and pregnancy; benign tumors of the uterus deforming uterine cavity; and malignant tumors of any localization.
Obligatory examination of gestational surrogates includes the following: a physician’s conclusion on physical health of gestational surrogates and absence of contraindications to pregnancy; blood type and Rh factor; complete blood count; coagulation tests; screening for syphilis, HIV, and hepatitis B and C; serology (IgM, IgG) for STDs; bacterial cultures of vagina, urethra, and cervix; general gynecologic examination; and ultrasound examination of the pelvic organs.

These are: a written official statement from the gestational surrogate; a copy of her passport; a copy of the birth certificate of her child (children); a copy of the marriage certificate or divorce certificate; and the written consent of the gestational surrogate’s husband for her participation in the surrogacy program. For single women, a notarized statement of gestational surrogate is signed, confirming she is not officially married and does not have a permanent partner.

Childbirth must be registered within a month after delivery. Failure to register a child within the specified period is considered an administrative offense and may result in a fine. A birth certificate is issued in Ukrainian and contains no information about gestational surrogacy or childbirth as a result of gestational surrogacy. If required, it can be translated into any language and notarized or legalized to be valid abroad.
